1. DEFINITIONS
LLOYDS DIGITAL or US or WE refers to the software company Lloyds digital d.o.o., Croatia, Rudarska 1, 52220 Labin, OIB 42238462344.
GDPR – the EU General Data Protection Regulation (the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC).
SERVICES means digital products, services, and free consultations made by Lloyds digital, such as custom made software solutions, mobile applications, web applications, or custom made websites.
PERSONAL DATA means any information that relates to an identified or identifiable living individual.
CONTROLLER means the natural or legal person which determines the purposes and means of the processing of personal data, and that person is responsible for processing such personal data in accordance with the GDPR and other applicable personal data protection European laws and the laws of the Member States on the protection of personal data.
PROCESSOR refers to a natural or legal person who processes personal data on behalf of the controller.
SUB-PROCESSOR refers to a natural or legal person who processes personal data on behalf of the controller, as specified in the agreement and in accordance with our instructions.
YOU refers to an individual, natural person, whose personal data is collected and processed by Lloyds digital.

We, Lloyds digital d.o.o., Croatia, Rudarska 1, 52220 Labin, OIB 42238462344 will be held responsible as a Controller for all personal data you provide us with in connection with our business relationship.
LLOYDS DIGITAL is a software company offering custom-made digital support in various industries, such as building a software solution, mobile application, either creating a new or improved version of a website. While providing these services to our clients and processing personal data, we act either as the controller or the processor, depending on the situation.
We act as the processor when processing personal data of individuals on behalf of our clients, and for the sole purpose of providing our services to them. We are processing the information within limits and according to the clients’ instructions, all in line with the conditions concluded with the client.
We act as the controller in situations when we process personal data for our own purposes, and we are committed to processing that information as described in this Privacy Notice.

3. PURPOSE AND LEGAL BASIS FOR PROCESSING PERSONAL DATA
When you visit our website https://lloyds-digital.com, use our services, subscribe to our newsletter, or simply contact us over the phone, mail or a contact form, you share your personal data with us. You trust us with your personal data. Unless otherwise agreed with you, we will collect only the basic personal data required in connection with our business relationship. While doing business with you, we will also collect business-related data which may include information on purchases, services and other business activities, product feedback and any other information you may provide to us.
We might collect your personal data directly from you for one of the following reasons:
- Delivery of products and services or intent to collaborate;
- Intent to become an employee or intern;
- General inquiry via email;
- Newsletter subscriptions;
- You initiated communication with us over website contact form;
- You initiated communication with us over social media profiles;
- When you browse our website – third party service (i.e. Google Analytics);

- We have collected your information from LinkedIn or other publicly available sources;
- Our client or partner provided us with the contact details of its representatives and personnel for the purpose of business;
- Our client or partner provided us with contact details of its clients/customers (such as name, telephone number or email address) in order to complete the project/partnership);
- Our employee/intern gave us your contact details as a referee contact point;
- From other sources (e.g. public databases, joint marketing partners, social media platforms, from people you are connected to on social media platforms, public forums, and other third parties); and
- Our client or partner provided us with the contact details of its personnel who will attend our event, i.e. international IT conference Digital Labin, Lloyds .ŝtori[e} meetup.
We collect personal data depending on the above-mentioned specific situation. We collect only the necessary information to provide you with adequate, complete, and best possible service, full of useful information.
We process your personal data necessary for the execution of the contract or in order to take action before concluding the contract within the meaning of Article 6 (1) (b) GDPR. These tasks and powers are prescribed by the provisions of the GDPR and the Law on the Implementation of the GDPR, and they include:
- delivery of products and services or intent to collaborate;
- providing consultations and opinions;
- intent to become an employee or intern;
- giving answers to received inquiries.
We process your personal data in fulfillment of our legal obligations under Article 6 (1) (c) of the General Regulation for the purpose of:
- responding to a request to exercise the right of access to information;
- employment in Lloyds digital.
We process your personal data on the basis of a legitimate interest within the meaning of Article 6 (1) (f) of the General Regulation, for the purpose of:
- participation in our educations and lectures;
- keeping records of the parties’ visits to the Lloyds digital premises;
- video surveillance for the purpose of protection of persons and property.
We process your personal data on the basis of consent within the meaning of Article 6 (1) (a) of the General Regulation, for the purpose of:
- future employment in Lloyds digital,
- better functioning of all features of the website and enabling a better user experience;
- newsletter subscriptions.
3.1. The communication is based on delivery of products and services or intent to collaborate, i.e. when we provide the services to our clients, when you provide your products or services to us.
Personal data we collect:
- NECESSARY: full name for a natural person or name of the representative for legal persons, contact details (full address, country, e-mail address, phone number), tax or similar unique identification number for natural and legal person, and related information such as the company’s name, industry, the business role of the representative.
- ADDITIONAL DATA: your login information (e.i. Login details, API key). Further, to utilize the services we also collect names, contact information, and login details of clients’ personnel or any other person authorized by the client. We may also collect billing information, legal entity status, and any other information that is necessary to complete the project.
Legal basis for collecting the data: performance of a contract (GDPR article 6.1.(b), consent (GDPR article 6.1.(a), legitimate interest according to GDPR article 6.1.(f) in the sense of providing our Services to you.
Time period for keeping the data: we will erase all personal data collected about you within 24 months after the termination of the Services, unless otherwise required by law. When based on the legitimate interests we will keep your email address until you object to the processing of your personal data for this purpose, or, in the case of the given consent until you withdraw your consent.
3.2. Intent to become an employee or intern
Personal data we collect: name, contact information (full address, country, e-mail address, phone number), information about education, VAT number, date of birth, personal identification number (e.i. OIB), bank account details, and any other information written in your resume (CV).
Legal basis for collecting the data: performance of a contract (GDPR article 6.1.(b), consent (GDPR article 6.1.(a), legitimate interest according to GDPR article 6.1.(f) in order to find potential job candidates.
Time period for keeping the data: until you withdraw your consent, until you object to the processing of your personal data for the purpose of future job opportunity.
3.3. General inquiry via email – when you contact us with a question about our products and services and when we are looking for a new business opportunities
Personal data we collect: name, e-mail address, phone number, country, and related information such as your company’s name, business role, telephone number, information about the project, budget of the project.
Legal basis for collecting the data: performance of a contract (GDPR article 6.1.(b), consent (GDPR article 6.1.(a), legitimate interest according to GDPR article 6.1.(f) in the sense of providing our Services to you.
Time period for keeping the data: if we do not enter into an agreement, we will delete your personal data within 24 (twentyfour) months after our last communication. When based on the legitimate interests we will keep your email address until you object to the processing of your personal data for this purpose, or, in the case of the given consent until you withdraw your consent.
3.4. Newsletter subscriptions
Personal data we collect: e-mail address, name.
We will send you updates and information about our new products and services, upcoming events or other advertising campaigns or news via email. We also gather statistics around email opening and click rates.
Legal basis for collecting the data: consent (GDPR article 6.1.(a), legitimate interest according to GDPR article 6.1.(f) in the sense of informing you about Us and our Services.
Time period for keeping the data: in the case of marketing communication is based on our legitimate interests we will keep the data until you object to the processing of your personal data for this purpose, or, in the case of the given consent – until you unsubscribe (i.e. withdraw your consent). *
LLOYDS DIGITAL may save your email address for the purpose of sending promotional and educational newsletters. Your e-mail address is stored in Kutina, on the company’s server, and will also be forwarded to the Mailchimp service that we use to send newsletters. We will keep your e-mail address until you unsubscribe from the newsletter. You can withdraw your consent at any time. Such withdrawal shall not affect the lawfulness of processing based on consent prior to its withdrawal. You can unsubscribe from receiving our newsletter at any time by clicking on the Unsubscribe icon that you will have in each individual issue of the newsletter. By withdrawing your consent you will no longer receive our newsletters but you will still be able to use our website and our other services.
* Inactive subscribers are those who have been on our list for more than 6 (six) months and didn’t open any of the emails we’ve sent. LLOYDS DIGITAL will remove these subscribers from our list by unsubscribing them.

3.7. When you browse our website – third party service (i.e. Google Analytics)
We use cookies to collect information that is used either in aggregate form to help us understand how our Website is being used or how effective our marketing campaigns are, or to help us customize our Website for you.
Personal data we collect: usually we collect IP addresses, browser type, the pages you’ve visited and the order you visited them, as well as whether you’re a new or returning visitor. This information is only processed in a way that does not identify anyone, but is helping us to maintain and improve our website and business. For more information please read our Cookie Policy.
Legal basis for collecting the data: consent (GDPR article 6.1.(a).

3.8. Public events participants
Personal data we collect:
- NECESSARY: full name for a natural person, or name of the representative for legal persons, company information (name of the company), e-mail (to inform you about the event and ask for your feedback).
- ADDITIONAL DATA:
We may also ask you for information about phone number, country, business role, place of your arrival, accommodation details and dietary information.
Legal basis for collecting the data: consent (GDPR article 6.1.(a), legitimate interest according to GDPR article 6.1.(f).
Time period for keeping the data: all personal data collected will be kept only for the duration of the public event and will be erased within 2 years after the event. In the case of marketing communication is based on our legitimate interests in accordance with GDPR article 6.1.(f) we will keep the email address until you object to the processing of your personal data for this purpose, or, in the case of the given consent – until you withdraw your consent.
3.9. Processing of personal data through video surveillance
Legal basis for collecting the data: legitimate interest according to GDPR article 6.1.(f).
Purpose: protection of persons and property.
Recipients: videos can be submitted on request to the competent authorities (police, court) if necessary for the implementation of proceedings under special regulations.
Categories of data recipients: data are not passed on to third parties except in the case of legal requirements or at the request of the competent state authority.
Time period for keeping the data: recordings obtained through a video surveillance system are kept for a maximum of three months or longer if they are exempted as evidence in court, administrative, arbitration or other proceedings.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this Privacy notice will require us to keep your personal information for longer than 2 years (24 months) after the termination of the Services. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.
4. WHO WE SHARE PERSONAL DATA WITH
We may pass on your personal data for use to providers of information and communication solutions and services that act as executors of processing. We have concluded agreements with the aforementioned processors in which the handling of personal data is prescribed in detail, so they are not able to process your personal data without our order and pass them on to third parties.
In certain circumstances, we have a legal obligation to transfer your personal data, and the processing of personal data may include the international transfer of the same. The legal obligation may arise from national or EU rules. Therefore, your information is passed on to other recipients when we are bound by the relevant regulations to the extent necessary to achieve the established purpose.
Your personal information will not be passed on to third parties for direct marketing purposes.

In order to deliver the services described by this policy, Lloyds digital uses products provided by Amazon Web Services, Inc. (AWS). All products provided by AWS are compliant with ISO security standard 27018, delivering the highest level of information security. Personal data is collected and stored in data centers located within the European Union. More information can be found in AWS’s Privacy Policy and Data Privacy FAQ. Any transfer of personal data to third parties listed in this policy happens over a secure connection. No personal data is transferred to third parties or to third countries other than what’s listed in this policy.
Otherwise, no third parties will have access to your personal data unless there is a legal requirement or you give us permission to do so.
Remember! We cannot guarantee that the Internet itself is 100% secure. Although we will do our best to protect your personal data, the transmission of personal data to and from our Website is at your own risk. You should only access the services in a secure environment.

Considering the mentioned above, we may share your personal data with third parties which are situated outside of the European Economic Area, however, all transfers of personal data are done in accordance with EU GDPR data protection standards.

We do not knowingly solicit data from or market to children under 18 years of age. 7.1. THE RIGHT TO OBJECT TO THE USE OF YOUR DATA
You have the right to object, i.e. to stop or prevent us from using your data in certain circumstances, and we may not need to stop processing your personal data if we give you strong and legitimate reasons to continue using your data.
You can only object to processing when we are using you data:

7.3. RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY
If you believe that we are processing your personal data illegally, you have the right to lodge a complaint with the personal data protection supervisory authority. In the Republic of Croatia this body is Agencija za zaštitu osobnih podataka (www.azop.hr). If your habitual residence, place of work or place of the alleged infringement is in the European Economic Area, or you believe that your rights have been violated, in any cases, you can lodge a complaint with a supervisory authority of that country.

8. CALIFORNIA SUPPLEMENTAL PRIVACY NOTICE
This Supplemental Privacy Notice applies solely to visitors, users, and others who are residents of the State of California pursuant to Section 17014 of Title 18 of the California Code of Regulations (“consumers” or “you”). 8.2. USE OF PERSONAL INFORMATION
We may use or disclose the personal information we collect, for either itself or its business partners or associations, for one or more of the following business purposes:
- To fulfill or meet the reason for which the information is provided. For example, if you share your name and contact information while inquiring about our services, requesting information or materials, or ask a question about our products or services, we will use that personal information to respond to your inquiry;
- To provide you with information, products or services that you request from us;
- To process your requests, transactions, and payments and prevent transactional fraud;

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you any required notice.
8.3. SHARING PERSONAL INFORMATION
We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we may enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.
In the preceding twelve (12) months, we may have disclosed the following categories of personal information for a business purpose:

For purposes of the CCPA, we do not “sell” personal information, nor do we have actual knowledge of any “sale” of personal information of minors under 16 years of age.
